Mable 10-year anniversary artwork competition

1.0 Introduction and Eligibility

1.1 The Mable 10-Year Anniversary Artwork Competition (the “Competition”) is organised by Mable Technologies Pty Ltd of Level 12, 255 Pitt St, Sydney NSW 2000 (“the Organiser”).

1.2 The Competition is open to individuals who meet all the following eligibility criteria:

  1. Participants must be 18 years of age or older.
  2. Participants must be residents of Australia.
  3. The Organiser’s employees, agents, and their immediate family members are not eligible to win the below prize.
  4. Participants must have, or have had in the past, an account on the Mable Platform.

1.3 Entry into the Competition constitutes acceptance of these Terms and Conditions.

1.4 Entry into this Competition is free (excluding any internet charges).

2.0 Entry Guidelines

2.1 To enter the Competition, Participants must:

  1. Create an artwork that shows us what they love about Mable. This could be a drawing, painting or a collage – whichever medium the entrant prefers.
  2. Send a picture of their work along with a short blurb describing what they have created.
  3. Provide their full name and email address (‘contact information’).

2.2 Contact information in connection with this Competition is collected for the purpose of identifying, contacting and sending the prize to the winner of the competition. Contact information and any other personal information provided as part of this competition is protected in line with Mable’s Privacy Policy.

2.3 Each Participant may submit as many entries as they like.

3.0 Competition Duration

3.1 The Competition will begin on 26 August 2024 at 9.00 am AEST and will end on 11 September at 5.00 pm AEST.

3.2 Entries received before or after the specified end date and time will not be accepted.

4.0 Property Rights

4.1 Participants retain ownership of the intellectual property rights to the artwork in their entries.

4.2 Participants warrant that their entry and the artwork does not infringe the intellectual property rights of any third party and indemnify the Organisation from any loss associated with claims by a third party regarding the Participant’s artwork or entry.

4.3 By entering the Competition, Participants grant the Organiser a non-exclusive, royalty free, worldwide licence to use the content of their entry, or any part of the content of the entry, in any way the Organiser wishes (including modifying, adapting, copying, cropping, retouching, editing, publishing, broadcasting or communicating the entry whether in original or modified form in whole or in part) in all media for the purposes of the Organiser’s business on its website, social media or in any marketing campaign, without payment to the entrant of royalties or compensation (‘Licence’). If requested by the Organiser, Participants agree to sign any further documentation required by the Organiser to give effect to this Licence.

4.4 The Licence also extends to the Organiser using and adapting the artwork submitted by the winner of the Competition for the purpose of creating a large-scale mural painted by a mural artist in Mable’s Sydney Office (the “Mural”). The artwork submitted to the Competition by the winner of the Competition will be used as central inspiration for the Mural and may not be an exact replica of the artwork submitted to the Competition.

4.5 The Organiser retains ownership of the intellectual property rights associated with any pictures taken with the winner and associated generated content, including any newly created intellectual property in the Mural.

4.6 The Organiser agrees to acknowledge the winner as the creator, or the inspiration for, the artwork that the Organiser uses, reproduces, publishes and displays under the licence. The winner consents to the sharing of their personal information for this purpose.

4.7 Participants consent to the Organiser using their name, likeness, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting the Competition (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Organiser.

5.0 Prizes

5.1 The winner will win $2000 worth of VISA gift cards (4 x $500 VISA gift cards).

5.2 The prize is non-transferable and cannot be exchanged or redeemed for cash or any other alternative.

5.3 The Organiser will collect the postal address of the winner of the competition. The postal address is collected for the purposes of sending the prize to the winning Participant. This information will be treated in line with Mable’s Privacy Policy.

5.4 The VISA gift cards will be sent to the postal address provided by the winner via registered post.

5.5 In addition, the winner will also be invited to attend the unveiling of the Mural on the 10 October 2024 at Mable’s Sydney Office (‘Event’) with one guest of their choice. If the winner, or the winner and their guest, wish to attend the Event, they will do so at their own cost unless otherwise agreed by Mable.

6.0 Winner Selection and Notification

6.1 All valid entries will be reviewed and the winner will be selected by the Organiser’s editorial team individually based on creativity. The Organiser has full discretion regarding the decision and its decision will be final.

6.2 The Organiser will endeavour to notify the winner via email, by 13th September 2024, 5:00 pm AEST.

6.3 If a winner cannot be contacted by 16th September 2024, 9.00 am AEST the Organiser reserves the right to disqualify that winner and select an alternate winner.

7.0 Disqualification and Termination

7.1 The Organiser reserves the right to disqualify any Participant who violates these Terms and Conditions or engages in fraudulent or inappropriate behaviour.

7.2 The Organiser may terminate or suspend the Competition at any time without prior notice and for any reason, including but not limited to technical issues, fraud, or force majeure events.

8.0 Limitation of Liability

8.1 The Organiser and its affiliates, partners, and agents shall not be liable for any loss, damage, or injury arising from or related to the Competition, including but not limited to:
  1. Any technical malfunctions, failures, or delays in entry submissions, notifications, or prize awards.
  2. Any errors or inaccuracies in the information provided by Participants.
  3. Any unauthorised access to or alteration of entries.
  4. Any cancellation of or change to the Event.
  5. The winner and their guest’s attendance at the Event, including any travel to and from the Event and associated events.

9.0 Governing Law and Jurisdiction

9.1 These terms and conditions shall be governed by and construed in accordance with the laws of New South Wales, Australia.

9.2 Any disputes arising out of or in connection with the Competition shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

10.0 General Terms

10.1 The Organiser reserves the right to amend or modify the terms and conditions at any time.

10.2 These terms and conditions constitute the entire agreement between the Organiser and Participants regarding the Competition.

10.3 If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall remain in effect.

10.4 The Organiser collects Participant information to include Participants in this Competition. Use of your personal information is governed by Mable’s Privacy Policy.
